1. Introduction
These Terms of Use govern access to and use of the KAMPP platform, including the mobile application, web dashboard, features, content, services, related pages, and other resources offered by KAMPP.
By creating an account, accessing, or using KAMPP, the user represents that they have read, understood, and agreed to these Terms.
If the user does not agree to these Terms, they must not access or use the platform.
2. Who We Are
Amna Digital LTDA, a private legal entity enrolled with the Brazilian National Registry of Legal Entities (CNPJ) under No. 65.169.810/0001-11, with headquarters at Rua Visconde do Rio Branco, 1488, Conj 909, Andar 09, Cond Universe Life Square, bloco Com., Centro, Curitiba, Paraná, CEP 80420-210, hereinafter simply referred to as “KAMPP”.
3. Key Definitions
For purposes of these Terms:
- KAMPP: the digital platform, including the app, web dashboard, features, services, and technological infrastructure.
- User: any registered person who uses KAMPP.
- Athlete: a user who uses the app to organize, track, receive, or perform workouts.
- Student: an athlete with an active paid KAMPP plan.
- Instructor: a user linked to a free coach plan.
- Coach: a professional, fitness trainer, gym owner, or other user who uses KAMPP to create, organize, assign, provide, or track workouts under a paid plan.
- Active Coach: a coach with athletes registered in their database and with workout check-ins recorded within the last 7 days.
- Active Athlete: an athlete with a workout check-in recorded within the last 7 days.
- Paying User: an athlete or coach with an active paid plan.
- Referral Program: KAMPP’s commercial program intended to compensate users for eligible referrals, in accordance with specific rules published at kampp.app/coachplans.
- Plans: commercial tiers, profiles, limits, resources, features, and restrictions published at kampp.app/plans.
- Notes Feature: a module containing observations, comments, records, classifications, tags, categories, or equivalent resources made available within the coach-athlete relationship.
- Meal Plan: content organized within KAMPP that may include meals, foods, quantities, schedules, nutritional goals, hydration, guidance, and information related to the athlete’s diet.
- Nutritional Content: meal plans, guidance, goals, information, recommendations, and other content related to food or nutrition entered, organized, or made available by users through KAMPP.
- Technical Responsible Professional: a professional identified by the coach or organization as technically responsible for certain activities performed with the support of KAMPP, including, where applicable, a Physical Education professional registered with CREF and a nutritionist registered with CRN. Registration of this information in KAMPP does not, by itself, constitute validation, certification, or a guarantee by KAMPP regarding the professional’s standing.
4. Eligibility
KAMPP is intended solely for persons who are 18 years of age or older and who have full legal capacity to enter into agreements and use the platform.
By accepting these Terms, the user represents that they:
- are at least 18 years old;
- have legal capacity to perform civil acts;
- will use the platform independently and responsibly with respect to the decisions they make within it;
- will provide truthful, complete, and up-to-date information.
5. Account Access
To use KAMPP, the user must create an account using valid and up-to-date information.
5.1. Single Account Rule
Each user may maintain only one account per email address.
KAMPP may block, suspend, merge, or terminate duplicate, conflicting, fraudulent accounts or accounts created in violation of this rule.
5.2. Registration Verification
KAMPP may verify the email address provided during registration and adopt additional authentication and security mechanisms whenever it considers them necessary to protect the platform and its users.
5.3. Social Login
KAMPP may allow social login through third-party providers. In such cases, use of this feature will also be subject to the rules and policies of the applicable provider.
5.4. Responsibility for Credentials
The user is responsible for maintaining the confidentiality of their password, credentials, and access information.
The user is responsible for activities carried out through their account until they formally notify KAMPP of suspected unauthorized access, intrusion, account compromise, or unauthorized use.
After receiving such notice, KAMPP may adopt reasonable protection, blocking, access reset, and verification measures, without any guarantee that actions carried out prior to the notice can be reversed.
KAMPP will not be liable for losses resulting from misuse of an account when such misuse results from the user’s own failure to safeguard their password, improper sharing of access, or equivalent conduct.
6. Profiles, Plans, Features, and Limits
User profiles, plan types, available features, usage limits, operational restrictions, and KAMPP commercial terms are defined and updated on the platform’s official pages.
6.1. Official Sources
Official information regarding plans, profiles, features, limits, and restrictions is available at:
- kampp.app/plans
- kampp.app/coachplans
- kampp.app/support/user-roles
These pages are incorporated into these Terms for all purposes.
6.2. Changes to Plans, Features, and Terms
KAMPP may change, expand, restrict, reorganize, replace, or discontinue plans, resources, features, limits, and commercial terms at any time.
Changes will take effect 30 days after notice is sent to the email address associated with the user’s account, unless a different period is required by law, a decision by a competent authority, an app store rule, a payment method, or an equivalent obligation.
7. Role of KAMPP
KAMPP is a technology platform for organizing, creating, hosting, providing, and tracking workouts, meal plans, content, and interactions between users, with management, monitoring, and relationship features available through the app and web dashboard.
KAMPP provides the technological infrastructure that allows users and professionals to use its resources according to their needs and qualifications, but does not assume technical or professional responsibility for content created or made available by them.
KAMPP:
- does not prescribe workouts or meal plans on its own behalf;
- does not provide medical, nutritional, or physical education services;
- does not review, validate, audit, or endorse methodologies, prescriptions, guidance, workouts, or nutritional content created by users;
- does not replace the evaluation, monitoring, or responsibility of a qualified professional where such professional involvement is required;
- does not act as a sub-acquirer;
- does not perform payment splitting;
- does not operate as a marketplace;
- does not sell, on its own behalf, customized workouts or meal plans created by users.
When a professional uses KAMPP to provide prescriptions, guidance, or monitoring as part of their professional activities, that professional will be solely responsible for the content, methodology adopted, suitability for the athlete, and compliance with the legal and professional requirements applicable to their activities.
Workouts and other content commercialized directly by the coach outside KAMPP’s commercial environment may be integrated into the platform to synchronize athletes or users with active access. If the gateway, external platform, or configuration performed by the coach does not properly authorize, identify, or synchronize the corresponding user, the coach will be responsible for configuring and ensuring compatibility of that flow.
8. KAMPP Subscription
The KAMPP subscription corresponds exclusively to access to the plans, resources, and features of the platform itself, and does not include the purchase of a customized workout sold separately by the coach outside KAMPP’s commercial environment.
KAMPP is not responsible for the quality, suitability, safety, technical delivery, or results of workouts purchased outside the platform. The coach is responsible for properly using KAMPP’s tools to organize, present, and make available, within the existing features, the workouts they commercialize independently.
8.1. Subscription Billing
KAMPP may offer its paid plans through:
- app stores;
- payment gateways;
- proprietary or third-party payment methods;
- authorized digital channels.
8.2. Automatic Renewal
All KAMPP subscriptions are automatically renewing, unless applicable law or a mandatory rule of the contracting channel requires otherwise.
8.3. Plan Renewal Date
Each subscription has a renewal date corresponding to the date on which it was originally purchased or most recently renewed.
If the user cancels before the renewal date, the next charge will not be made, but access will remain active until the end of the current billing cycle.
If cancellation occurs after the billing cycle has renewed, access will remain active until the end of the period already charged.
8.4. Free Trial
KAMPP does not offer a free trial period to athletes.
Free trial periods may be made available exclusively to coaches, according to the current commercial policy and the conditions presented through the applicable contracting channel.
KAMPP may also make free plans available in accordance with its current commercial policy.
8.5. Refunds
KAMPP does not voluntarily provide refunds outside the circumstances required by applicable law, including statutory withdrawal rights where applicable, or the specific rules of the applicable payment method, app store, or other legal obligation.
9. Nonpayment, Blocking, Cancellation, and Downgrade
9.1. Nonpayment
In the event of a failed charge or nonpayment, KAMPP may immediately block access to paid features.
The user will have up to 5 days to resolve the issue, counted from the attempted charge or notice sent by KAMPP.
9.2. Downgrade
Downgrades will not occur automatically by default. When available, a downgrade will require the user’s interaction and acceptance through the corresponding flow within the app or dashboard.
9.3. Archived Content
In the event of loss of access to a paid plan, cancellation, downgrade, blocking, or contractual restriction, excess or unavailable content may be archived, which means that:
- it will remain associated with the account for a limited period;
- it may become invisible or partially obscured to the user;
- it may be displayed using visual blocking, blur, or an equivalent feature;
- it will not be exportable while an eligible plan is not active;
- it may automatically become accessible again if the account is reactivated or upgraded to an eligible plan.
9.4. Reactivation Period
The account may be reactivated by the user within up to 3 months after cancellation or blocking, subject to plan rules and the technical eligibility of the account.
9.5. Access Period After Cancellation
After cancellation, the user may retain restricted access to account information for up to 3 months, according to KAMPP’s then-current operational configuration.
9.6. Permanent Deletion
Archived data may remain stored for up to 1 year of inactivity. After this period, it may be permanently deleted, including:
- workouts;
- meal plans;
- food records;
- nutritional goals;
- hydration information;
- athletes in the coach’s database;
- notes;
- history;
- logs;
- conversations;
- records associated with use of the platform.
KAMPP is not obligated to retain content, data, or history after this period.
10. Athlete-Specific Rules
When using KAMPP as an athlete, the user acknowledges and agrees that:
- KAMPP does not provide medical, clinical, nutritional, physical therapy, or hospital services;
- KAMPP does not replace physical assessment, medical or nutritional monitoring, or guidance from a qualified professional where necessary;
- workouts, meal plans, guidance, goals, and other content made available through the platform may have been created by coaches, nutritionists, other professionals, or users and are the responsibility of the person who created or made them available;
- the performance of exercises, as well as the decision to follow meal plans, guidance, or recommendations received through KAMPP, is the athlete’s own decision;
- the athlete is responsible for considering their health condition, physical limitations, dietary restrictions, allergies, intolerances, clinical conditions, use of medications, and other relevant circumstances before following any workout, meal plan, guidance, or content;
- where there is uncertainty, a specific health condition, or a need for professional monitoring, the athlete should seek guidance from a duly qualified professional;
- the athlete is responsible for the data and information they choose to share with coaches and professionals within the platform.
By accepting these Terms, the athlete represents that they have sufficient judgment to make decisions regarding use of the app, their workout and dietary routine, and the information they share within the platform.
11. Coach-Specific Rules
When using KAMPP as a coach or professional, the user acknowledges and agrees that:
- they are solely responsible for the workouts, meal plans, content, guidance, observations, prescriptions, assignments, monitoring, and other materials they enter, organize, associate, or make available on the platform;
- they are responsible for the suitability, safety, legality, clarity, accuracy, and relevance of the content they enter or make available;
- they are solely responsible for prescriptions, guidance, and professional decisions made with the support of KAMPP, including those related to training, diet, and nutrition;
- they must use the platform’s features within the limits of their education, professional qualifications, and applicable law;
- the existence or availability of a feature in KAMPP does not constitute authorization, licensing, or professional qualification to perform a regulated professional activity;
- when an activity requires education, professional registration, or specific qualifications, it is solely the user’s responsibility to ensure that they meet the necessary requirements;
- any self-declaration regarding qualifications, professional practice, experience, registration, or professional standing is solely the user’s responsibility.
KAMPP does not define, review, validate, audit, or endorse methodologies, prescriptions, meal plans, workouts, guidance, or other content produced by users and does not assume technical or professional responsibility for them.
11.1. Technical Responsible Professional
KAMPP may allow coaches or organizations to identify professionals who are technically responsible for certain activities performed with the support of the platform, including different responsible professionals for workouts and meal plans.
The user or organization making this registration is responsible for the truthfulness, current status, and regularity of the information provided, including the professional’s name, professional registration, professional council, and relationship with the identified professional.
Registration of the Technical Responsible Professional functions as a record provided by the user or organization itself and does not mean that KAMPP has validated, certified, or guaranteed the professional’s education, qualifications, professional registration, or standing before the applicable professional council.
The professional identified remains responsible for prescriptions, guidance, and other professional acts performed within the scope of their professional practice.
11.2. Declaration of Absence of Professional Registration
When the user states that they do not have professional registration with a professional council, KAMPP may require an express and recordable declaration of this condition for continued use of the platform’s features.
This declaration does not replace any registration, license, qualification, or other applicable legal or professional requirement, nor does it constitute authorization by KAMPP to engage in a regulated professional activity.
The user remains fully responsible for using the platform within the limits of their education, qualifications, and applicable law, as well as for the content, guidance, and prescriptions they make available.
12. Sale of Customized Workouts
Customized workouts created by coaches are sold outside the app’s commercial environment, through channels, platforms, and payment methods chosen by the coach.
12.1. Commercial Responsibility for Customized Workouts
The coach is solely responsible for:
- offering the workout;
- pricing;
- billing;
- issuing invoices, where applicable;
- refunds;
- cancellations;
- the commercial relationship with the athlete;
- technical delivery of the content sold;
- recurring transactions contracted outside the app;
- compliance with legal obligations related to the sale of the workout.
12.2. Role of KAMPP
KAMPP provides the technological environment for hosting, organizing, and consuming workouts, where applicable, without assuming the role of seller, reseller, or commercial intermediary in the transaction carried out between the coach and the athlete.
13. Notes, Observations, and Communication Between Users
KAMPP may provide notes, observations, comments, classifications, categories, tags, fields, histories, markers, chronological records, attachments, and related resources intended for communication and monitoring between coach and athlete.
13.1. Product Evolution
KAMPP may create, change, expand, restrict, reorganize, or discontinue these features over time, without any obligation to maintain specific formats, classifications, terminology, or categories.
13.2. Visibility
Notes and records within this module are intended for the relationship between coach and athlete, according to the feature enabled on the platform.
13.3. Responsibility for Content
Content entered into this module is entirely the responsibility of the users who produce or maintain it.
KAMPP does not review, validate, audit, interpret, certify, or assume responsibility for content included in this environment, even when it involves personal data, sensitive data, health information, diagnoses, physical restrictions, behavioral characteristics, subjective observations, or any other type of information entered at the initiative of users.
13.4. Nature of the Feature
KAMPP’s Notes Feature:
- does not constitute a medical record;
- does not constitute a clinical record;
- does not constitute a formal medical history assessment;
- does not constitute a diagnostic tool;
- does not replace professional, clinical, or medical assessment.
Users agree to use this feature responsibly, privately, consistently with the purpose of the platform, and in compliance with the law, morality, good customs, and third-party rights.
14. Referral and Commission Program
KAMPP may maintain a referral program with specific commercial rules, including compensation for eligible referrals.
14.1. General Rules
The complete conditions of the program will be available at kampp.app/coachplans, which is incorporated into these Terms.
14.2. Commission
Unless a different promotional rule has been duly published, the standard program commission will be 30% on eligible referrals of paying athletes and coaches, in accordance with the current program rules.
14.3. Attribution Criteria
Referral attribution will follow a last click model, according to valid KAMPP records and the other applicable technical and commercial rules.
14.4. Calculation, Release, and Payment of Commissions
The calculation, formation of balance, release, retention, blocking, review, offsetting, reversal, and payment of commissions will follow the rules of the applicable commercial program and the KAMPP Payout and Commissions Policy.
14.5. Payout and Commissions Policy
Payout registration, document validation, eligibility criteria for payment, balance release periods, minimum payout amounts, applicable tax requirements, blocking, retention, review and reversal rules for commissions, as well as other operational conditions related to coach payments, will be governed by the KAMPP Payout and Commissions Policy, available at kampp.app/payout-policy, which supplements these Terms for all applicable purposes.
15. Internal Profiles and Access Sharing in Coach Accounts
Access sharing is prohibited as a general rule, except where expressly permitted by KAMPP for team structures associated with eligible coach accounts.
When enabled, KAMPP may provide internal access profiles, permissions, and specific limitations as described at kampp.app/support/user-roles.
These profiles may include, among others:
- Owner / Admin
- Finance
- Analyst
- Viewer / Read Only
KAMPP may change these roles, permissions, names, scopes, and restrictions as the product evolves.
The primary account holder is responsible for access granted to their team and for use of the environment by authorized users operating within their account structure.
16. Account Transfer
Accounts may not be freely transferred to third parties.
Exceptional transfer requests may be reviewed by KAMPP upon the express consent of both parties and formal submission to [email protected], without any obligation for KAMPP to approve the request.
17. Prohibited Content and Misuse
It is prohibited to use KAMPP to:
- commit fraud;
- simulate users, accounts, or commercial relationships;
- enter illegal, offensive, discriminatory, abusive content or content that violates third-party rights;
- engage in harassment, spam, or improper disturbance;
- manipulate referral program rules;
- use the platform for unlawful purposes;
- publish content known to be misleading, manifestly reckless, or incompatible with the purpose of the platform;
- violate the security, integrity, stability, or operation of the system;
- circumvent KAMPP’s technical, commercial, or operational limits.
KAMPP may remove content, restrict features, suspend accounts, or terminate access in cases of:
- abuse;
- fraud;
- complaints;
- legal violations;
- misuse of the platform;
- risks to the security of the environment;
- violation of these Terms.
18. Intellectual Property
All rights in and to KAMPP, including its software, interface, trademark, visual identity, flows, features, structural database, native library, documentation, institutional texts, and other platform assets belong to KAMPP or its licensors.
18.1. User Content
The user remains responsible for content they create and enter into the platform, to the extent applicable.
18.2. License to KAMPP
By entering content into KAMPP, the user grants KAMPP a non-exclusive, royalty-free, worldwide license, limited to operation of the platform, to:
- host;
- store;
- organize;
- process;
- display to the appropriate recipient;
- allow export;
- perform backups;
- maintain technical records;
- operate the contracted features.
This license exists solely to the extent necessary to operate the service and comply with legal, regulatory, security, and support obligations.
19. Privacy and Personal Data
The processing of personal data in connection with KAMPP will be governed by its Privacy Policy, available at kampp.app/privacy-policy, which is incorporated into these Terms for all purposes.
KAMPP may process registration data, account data, billing data, usage logs, workout data, data related to meal plans and diet, operational history, content entered by users, and functional records necessary for operation of the platform, subject to the purposes described in its Privacy Policy and applicable law, including the LGPD.
KAMPP is responsible for operating the platform and processing data necessary for operation of the service, while coaches and professionals remain responsible for the content, observations, prescriptions, guidance, and other information they enter or make available within the platform in relation to their athletes.
19.1. Offers, Communications, and Commercial Opportunities
KAMPP may use data and information provided or generated by users in connection with use of the platform for:
- operational communications;
- offers regarding features, plans, products, services, campaigns, and opportunities related to the KAMPP ecosystem;
- personalization of experiences, communications, and recommendations within the limits permitted by applicable law and the Privacy Policy.
19.2. Institutional and Commercial Use of Coach and Organization Identification
By using KAMPP as a Coach, professional, or organization, the user authorizes KAMPP to use their name, trade name, brand, logo, profile image, professional identification, and testimonials voluntarily provided for KAMPP’s own institutional, promotional, and commercial purposes, including on websites, landing pages, presentations, sales materials, social media, advertisements, and communications related to the platform.
Such use may include, for example, identifying Coaches, professionals, gyms, or organizations that use or trust KAMPP, as well as promoting case studies, testimonials, and social proof initiatives.
KAMPP will not use confidential information, sensitive personal data, or private user content for these purposes without specific authorization.
The user may request that KAMPP discontinue future use of their identification or image for these purposes by contacting [email protected], without affecting materials already produced, published, or contracted prior to the request.
19.3. Use of Athlete Identification
The use of an Athlete’s name, image, voice, testimonials, photographs, videos, results, or any other element that identifies the Athlete in KAMPP advertising, promotional, institutional, or commercial materials will require the Athlete’s specific, prominent, and verifiable authorization, except where such use occurs in an anonymized, aggregated manner without personal identification.
20. Integrations, Third Parties, and App Stores
KAMPP may rely on integrations, third-party services, app stores, authentication providers, payment gateways, cloud infrastructure, and other technology partners.
Platform operation may be affected by outages, failures, updates, limitations, or rules imposed by such third parties.
When a plan is purchased through the Apple App Store, Google Play, or an equivalent environment, the respective store operator’s rules may also apply, including rules regarding billing, renewal, cancellation, and refunds.
21. Availability and Limitations of Liability
KAMPP seeks to maintain the platform in proper working condition, but does not guarantee uninterrupted availability, absence of failures, error-free operation, universal compatibility, or suitability for any user’s specific purposes.
To the maximum extent permitted by law, KAMPP will not be liable for:
- decisions made by athletes, coaches, professionals, or third parties based on content made available through the platform;
- injuries, physical harm, aggravations, adverse effects, or other consequences resulting from workouts, exercises, meal plans, guidance, or other content created or made available by users;
- the technical quality, safety, suitability, methodology, or legality of workouts, meal plans, prescriptions, nutritional guidance, or other content created by users or professionals;
- consequences related to dietary restrictions, allergies, intolerances, clinical conditions, use of medications, or other individual circumstances that were not adequately considered by the person responsible for the content or by the athlete;
- differences, inaccuracies, or limitations in nutritional information, calorie values, macronutrients, goals, estimates, calculations, or data made available by the platform or obtained from databases and integrations used by the service;
- external commercial transactions carried out between coaches, professionals, and athletes;
- losses resulting from temporary unavailability, third-party integrations, or external failures;
- misuse of an account by the user or by third parties prior to formal notice of account compromise.
21.1. Maintenance, Unavailability, and Operational Limitations
KAMPP may temporarily suspend, restrict, interrupt, or limit access to the platform or specific features when necessary due to:
- maintenance;
- updates;
- security;
- technical adjustments;
- legal or regulatory requirements;
- unavailability of third-party services;
- events beyond KAMPP’s reasonable control.
KAMPP may establish availability targets or service levels according to the applicable plan, contract, or commercial condition.
Where a specific availability commitment applies, exclusions from its calculation may include scheduled maintenance, third-party outages, force majeure events, security incidents, connectivity failures, user-caused limitations, and other circumstances outside KAMPP’s reasonable control.
22. Suspension, Termination, and Inactivity
KAMPP may suspend, restrict, or terminate accounts in the event of:
- violation of these Terms;
- fraud or reasonable suspicion of fraud;
- legal or regulatory requirements;
- risks to platform security;
- a relevant complaint;
- extended periods of inactivity;
- use incompatible with the purpose of the service.
The user may also terminate their account, subject to the cancellation, retention, archiving, and deletion rules set forth in these Terms and the Privacy Policy.
23. Communications
The user agrees to receive communications from KAMPP by email, in-app notifications, dashboard notices, operational messages, and other reasonable means regarding:
- security;
- billing;
- contractual changes;
- changes to plans and resources;
- support;
- mandatory communications.
Communications sent to the registered email address will be considered valid for all purposes.
24. Changes to These Terms
KAMPP may amend these Terms at any time to reflect changes to the platform, its features, commercial conditions, legal requirements, or operational practices.
Changes with a material impact on profiles, plans, resources, limits, restrictions, or commercial conditions will take effect 30 days after notice is sent to the email address associated with the user’s account, unless a different period is required by law, a decision by a competent authority, an app store rule, a payment method, or an equivalent obligation.
Other changes may take effect on the date specified by KAMPP.
Continued use of the platform after the updated version becomes effective constitutes acceptance of the updated Terms.
25. Governing Law and Venue
These Terms will be governed by the laws of the Federative Republic of Brazil.
The courts of Curitiba, State of Paraná, Brazil, are elected as the venue for resolving disputes relating to these Terms, with waiver of any other venue, however privileged it may be, except where mandatory law provides otherwise.
